Trust is binary in systems design.
In April 2025, ICE sent Google an administrative subpoena requesting data on a student journalist. The next month, Google complied. They handed over personal and financial information—breaking a decade-long privacy promise in the process. Now the Electronic Frontier Foundation has filed a complaint, and those of us building bots on Google’s infrastructure need to talk about what this means for our users.
Why Bot Builders Should Care
I build conversational AI systems. My bots live on Google Cloud, use Google’s APIs, and store user data in Google’s databases. I’ve told clients their information is secure. I’ve pointed to Google’s privacy policies. I’ve designed architectures assuming Google would fight overreach.
That assumption just died.
When you architect a bot system, you make implicit promises. Your users share sensitive information—medical questions, financial concerns, immigration status, personal struggles. They trust your bot because they trust your infrastructure. But if your cloud provider folds to an administrative subpoena without a warrant, your architecture doesn’t matter. Your encryption doesn’t matter. Your access controls don’t matter.
Administrative Subpoenas Are Not Warrants
This distinction matters enormously. A warrant requires probable cause and judicial oversight. An administrative subpoena is issued by the agency itself—no judge required. ICE wrote itself a permission slip, and Google said yes.
For bot builders, this creates a nightmare scenario. You can implement perfect security practices, encrypt everything at rest and in transit, follow every compliance framework—and still lose control of your users’ data through a legal mechanism that bypasses all your technical safeguards.
What This Means for Your Bot Architecture
First, audit your data retention policies immediately. Every piece of user data you keep is a liability. If you’re storing conversation logs “just in case” or keeping user profiles longer than necessary, stop. Implement aggressive data minimization. What you don’t have, you can’t be forced to hand over.
Second, reconsider your cloud provider strategy. I’m not saying abandon Google Cloud—but I am saying you need a plan B. Look at providers in jurisdictions with stronger privacy protections. Consider hybrid architectures where sensitive data never touches US servers.
Third, be honest with your users. Update your privacy policies. Tell them explicitly that you cannot guarantee protection from government requests. Yes, this is uncomfortable. Yes, it might hurt conversions. But the alternative is worse.
The Bigger Problem
This incident reveals something broken in how we build AI systems. We’ve created a centralized infrastructure where a handful of companies control the data of millions. When those companies cave to government pressure, there’s no technical solution that can protect users.
The student journalist whose data Google handed over had no way to prevent this. They used Google services, probably because everyone does. They trusted Google’s privacy promises, probably because those promises seemed solid. Now ICE has their information, and there’s no undo button.
What I’m Doing Differently
I’m redesigning my bot architectures with the assumption that any data stored on major cloud platforms is accessible to government agencies. That means:
- End-to-end encryption where users control the keys
- Zero-knowledge architectures where possible
- Aggressive data deletion schedules
- Geographic distribution of sensitive data
- Clear documentation of what data exists where
None of this is perfect. But it’s better than pretending the old promises still hold.
Trust Is Binary
You either protect user data or you don’t. There’s no middle ground. Google chose compliance over privacy, and now every bot builder using their infrastructure needs to decide what that means for their users.
I’m not shutting down my Google Cloud projects tomorrow. But I am rethinking every architectural decision I’ve made that assumed Google would be a reliable privacy partner. You should too.
Because the next subpoena might have your users’ names on it.
